1.2 By visiting the Site, you are agreeing to the practices described in the T&C. We may modify the T&C from time to time and Your continued use of this Site (or any of our other Sites) following such change shall signify Your agreement to be bound by the modified T&Cs.
1.3. The products displayed on the Site are offered for sale to consumers only. The Site is available to individuals who are adult and who can otherwise lawfully enter into and form contracts in accordance with the applicable laws and meet O’FILIGO's terms of eligibility
2.1. All products/services and information displayed on the Site constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. O’FILIGO reserves the right to accept or reject Your offer.
2.2. These T&Cs will apply to any contract between us for the sale of products on the Site to you. Please read these T&Cs carefully and make sure that you understand them before ordering any products from the Site ("Products"). By placing the order, you are agreeing with these terms.
2.3. Some of the services or features available on the Site require you to register with us. This is a one time process and comes with many benefits like special alerts, exclusive offers and much more. For registration we require some information about Yourself that is true, and complete in all respects. In case any of your registered information changes, kindly notify us at the following e-mail address email@example.com. We may also change registration requirements from time to time.
2.4. The account password shared should be unique and kept secure, and You must notify O’FILIGO immediately of any breach of security or unauthorized use of Your account. Although O’FILIGO will not be liable for Your losses caused by any unauthorized use of Your account, you may be liable for O’FILLIGO's losses or others due to such unauthorized use.
3.2. In order to make purchases on the Site You will be required to provide Your personal details. In particular, you must provide Your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that You represent and warrant are both valid and correct and You confirm that You are the person referred to in the billing information provided.
3.3. The purchase of merchandise through the Site is strictly limited to individuals who can lawfully enter into and form contracts on the Internet in accordance with the applicable laws.
4.1. Products purchased by You are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, by making an offer to purchase merchandise from our Site, you expressly authorize us to perform credit checks and, where O’FILIGO feels necessary, to transmit to or from third parties solely to authenticate Your identity, to validate your credit/debit card, to obtain an initial credit card authorization and/or to authorize individual purchase transactions.
4.2. Please note that currently, we are not able to deliver to certain countries. Kindly contact us by email, before placing your order to ensure deliveries can be made to your country of choice.
4.3. Selected products in Your shopping bag or wish list are subject to acceptance and availability, are not reserved and may be purchased by other customer(s).
4.4. Please note that all orders are subject to stock availability and in the event that your order is inadvertently accepted but without sufficient stock to fulfil the order, your order in respect of that item will be deemed null and void and you will be entitled to a full refund or exchange as you wish. You must ensure that you provide a full address including any relevant post code. Delivery costs are set out at the time your order is placed. Delivery will not be effected until full payment is received. O’FILIGO will inform you as soon as possible if the goods you have ordered are not available.
5.1. We accept payment by PayPal and all major debit/credit cards, except American Express. All prices are quoted in UK sterling and are inclusive of VAT, where applicable at the current rates and are correct at the time of posting the information. The total cost of your order is the price of the products ordered plus delivery. The final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your debit/credit card company processes the transaction. International orders may be subject to the relevant import taxes and customs duties and fees of the destination country. O’FILIGO is not liable for any such taxes, duties or fees. Orders placed by you are an offer to purchase and a contract is only formally created once your offer to purchase is accepted by us. You will receive an email confirmation once your order has been accepted.
5.2. VAT / EU POLICY
Customers outside the EU are exempt from UK value added tax (VAT) when shopping on our site. All prices are inclusive of VAT at 20%. Approximate prices in alternative currencies can be viewed by selecting the currency tab at the top of the site. Purchases from the EU are tax free and deducted at checkout.
6.1. Current "Rest of World" delivery countries include - Australia, China, Hong Kong, Iceland, Indonesia, Japan, Malaysia, New Zealand, Norway, Saudi Arabia, South Africa, South Korea, Singapore, Switzerland, Thailand and UAE. The estimated delivery times above are to be used as a guide only and commence from the date of dispatch. O'FILIGO is not responsible for any delays caused by the customs clearance process.
Please note that the shipping rates are not inclusive of any taxes, duties or import fees that may be charged when a package reaches it's destination country. All orders are shipped DDU (Delivered Duty Unpaid).
7.1. For each product offered for sale on the Site, a picture of such product will be displayed, with the unitary price, and the colours and sizes available. Pictures of products are provided purely to illustrate the product. Although we have made every effort to display the colours and dimensions accurately, O’FILIGO will not be responsible for any insufficient graphical representation of the products showcased on the Site on your computers display. All our products are almost all or part hand made by artisans, so recurring variations may be noted in some of our designs/products. These all add to the uniqueness and exclusivity of the products. Due to technical reasons, we allow order of only 10 units per design. For bulk orders, please e-mail customer service at firstname.lastname@example.org.
7.3 Until “Order confirmation” has been received from O’FILIGO, your purchase is not complete. We will confirm acceptance of the order by sending an email that confirms that Your order has been shipped (the "Shipping Confirmation"). A paper invoice will be included with the product. Once the order has been shipped it cannot be changed or cancelled. The Contract between us will only be formed when we send you the Shipping Confirmation.
7.4 O’FILIGO reserves the right to refuse orders made by any person it considers, in its sole discretion, as not having the eligibility to place an order or with whom a legal dispute regarding a previous order is on-going or for any other legitimate reason, without any need to provide the reasons for the same. O’FILIGO reserves the right to refuse and not to process orders which, in its sole discretion, appear to be sent by dealers and/or distributors.
7.5. We reserve the right to cancel the contract between you and us if:
a] we have insufficient stock to deliver the goods you have ordered; or
b] one or more of the items you have ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
7.6 If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible, within 28 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
7.8 O’FILIGO invites You to check the availability of products offered for sale on the Site at the time of purchase. Products sold by O’FILIGO on the Site may be subject to stock limits, and O’FILIGO does not guarantee that they will always be available.
7.9. Some products are producted by special order, only. These may take up to 12 weeks to delivery. Please check with O'FILIGO if you are unsure of delivery time frames.
7.10 Depending on availability, ordered Products will be shipped to You within 48 hours. In the event of a high demand of the ordered Products, we will try to ship the order to You within 7-10 days. Furthermore, if the ordered Product is temporarily unavailable or is listed as a bulk order, we will try to ship the same within 30 days. The estimated shipping time will be confirmed to You along with your Order Confirmation. However, in case of any query you can e-mail customer service at email@example.com
8.1. Shipping, Insurance, UK applicable Taxes and Duties are included in the Product price and visible according to Your shipping destination. Details are itemized on the order summary or checkout page. Further, Duties and Taxes, maybe applicable outside UK, please check before placing your order.
8.2 While we will make reasonable efforts to provide accurate and timely pricing information, errors may occur. If an error in the price of the products You ordered is identified after O’FILIGO sends You the Order Confirmation and before the products are dispatched, O’FILIGO will contact You and ask You if you want to re-confirm the order at the correct price or to cancel it. If O’FILIGO is not able to contact You, it will cancel the order and send You an email confirming the cancellation.
8.3. The amount will be deducted immediately after the online purchase. The purchased products will only be shipped after successful transaction.
8.4. To help ensure that Your shopping experience is safe, simple and secure O’FILIGO uses Secure Socket Layer (SSL) technology.
8.5. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of Your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss You may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
9.1. Following Order Confirmation, your ordered products will be dispatched to the address provided during the purchase process. For security reasons, O’FILIGO will not ship any order to a P.O. Box or accept any order where it is impossible to identify the individual private recipient of the order, and its address.
9.2. All purchases will be delivered by O’FILIGO's selected courier service (hereinafter, "Courier") between Monday and Friday excluding Saturdays, Sundays and local or national holidays, after the Order Confirmation is sent to You, on the basis of the indicated availability. Except where specially requested. Please check delivery costs as these will differ from standard shipping costs. O’FILIGO will not be responsible for delays that are unforeseeable and/or attributable to the Courier service provider. Please note that estimated delivery times are to be used as a guide only and commence from the date of dispatch, O’FILIGO is not responsible for any delays caused by Courier or destination customs clearance processes.
9.3. In the event You do not receive the product(s) you purchased within 25 business days following receipt of the Order Confirmation, you can e-mail customer service at firstname.lastname@example.org. O’FILIGO reserves the right not to respond to any such inquiries sent after 30 days from receipt of the Order Confirmation by You.
9.4. Your Order may be subject to import duties and taxes for which you are liable, which are applied when the delivery reaches your country. Please note that we have no control over these charges and we cannot predict their amount. Please contact your local customs office for further information before placing your order.
9.5. O’FILIGO insures each purchase during the time it is in transit until it is delivered to Your specified delivery address. We require a signature for any goods delivered, at which point responsibility for Your purchased goods passes to You. If You have specified a recipient who is not You for delivery purposes (for example as a gift) then You accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by O’FILIGO, and transfer of responsibility in the same way.
9.6. Please note that we require a receiving signature by an adult or responsible person, (as per the applicable laws) for all deliveries and therefore we do not ship to PO Boxes/FPO/APO addresses.
9.7. Delivery of orders will not be made on the national holidays or any such other day prescribed as a holiday by the respective government/local authority.
9.8. O’FILIGO will only deliver Your package to the address that was requested when Your order was placed. We don’t re-route any packages.
10.1. If you are a consumer, you have a legal right to cancel a contract during the period set out below in clause 10.2. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the contract by email to: email@example.com or write to:

10.2. O’FILIGO will accept the return of any items ordered through our website. You must inform us in writing within 7 days of receipt of your item. It is also your responsibility to ensure that the item is received by us no later than 28 days from the date on which you received the item and returned in an unused and re-saleable condition with the original packaging. You will also be responsible for all attending costs, duties, taxes, etc. O’FILIGO will also offer you the option of exchanging the item for something else in stock.
10.3. If you receive a faulty or damaged item, then you must notify us within 7 days of receipt and we will offer you the choice of an exchange or full refund (including your delivery charges). The item must then be returned by you to us, the reasonable costs ( which must not exceed the delivery costs) of which we will also refund. Refunds will be made by the original payment method within 28 days of the receipt by us of the item.
O’FILIGO reserves the right to reject returns made outside the stated timeframes.
10.4. Your legal right to cancel a contract starts from the date of the dispatch confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the contract between us is formed. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount. The shipping cost, insurance cost, duty fee, VAT and other taxes shall also be subject to deduction from the order amount.
10.5. If a Product has been delivered to you before you decide to cancel your Contract, unless the Product is faulty or not as described, you will be responsible for the cost of returning the Products to us. If the Product is one which cannot be returned by post, we estimate that if you use the carrier which delivered the Product to you, these costs should not exceed the sums we charged you for delivery.
10.6. It is your responsibility to ensure the merchandise is returned in its original condition, all tags and packaging included. Check the presence of the label and commercial documents accompanying the products within the package. We will acknowledge receipt by email of your return request.
10.7. O’FILIGO reserves the right to inspect the product(s) returned and to refuse the return of those product(s) which do not comply with the requirements specified. Faulty Goods: Goods are faulty if they are received damaged. Items that are damaged as a result of normal wear and tear are not considered to be faulty. You agree that the decision of O’FILIGO with respect to such determination shall be final.
10.8. O’FILIGO will not be liable for refund for Products which have not been received by O’FILIGO as a consequence of loss, theft or damage not attributable to O’FILIGO.
11.9. Repeated Returns: We offer a flexible returns policy to make Your online shopping experience even easier. However, we do monitor the number of returns made and may refuse to accept orders at our discretion if goods are returned repeatedly.
11.1. We regret that we are unable to offer refunds on any sale items (unless proven faulty) outside of the 7 day 'cooling off' period as dictated by the UK Distance Selling Regulations. To take advantage of the Distance Selling Regulations please contact us prior to sending the goods back stating you wish to return them under this scheme.
12.1. We have made every effort to showcase as accurately as possible the colours of our products that appear on ofiligo.co.uk. However, as computer monitors vary, we cannot guarantee that your monitor's display of any colour will be completely accurate.
12.2. We ensure that all items are quality controlled and checked for any faults before they are dispatched to You. Should You receive an item that is not in perfect condition please contact us immediately.
12.3. Please send all items You wish to return from an order in the same shipment to ensure Your return is processed as quickly as possible. Items should be returned in their original packaging to ensure they are adequately protected in transit. O’FILIGO will not be liable for any damage caused during return.
13.1. Products received on order must be checked by You at the time of delivery to ensure that they correspond to the products You ordered.
13.2. Any variances identified at the time of delivery, including any tampering or damage to the packaging, damage to the products, missing items, non-conformity to the products ordered, defective products, etc. (hereinafter "Defects"), can be indicated by You directly to the Courier by inserting a written and signed comment on the feedback form. In such circumstance You will not be required to accept the products and may return them directly to the Courier.
13.3 In the event that any Defects are identified after delivery, then You may return the product to O’FILIGO following the procedure described under Section 10.
14.2. All changes and/or corrections mentioned above will apply only to purchase orders submitted subsequent to the date of the change or correction made by O’FILIGO. Unless O’FILIGO decides, in its sole discretion, to cancel an order or You accept to re-confirm the order, You will be charged immediately the prices appearing on the Order Confirmation after a successful transaction.
15.1. All worldwide intellectual property including any copyright, registered or unregistered design rights in and relating to the goods including any blueprints, designs, drawings, illustrations, images, specifications and instructions prepared by us in connection with the order shall vest in us unless set out by express agreement in writing.
The trademarks, logos and service marks (intellectual property) displayed on our website are the registered and unregistered marks of O'FILIGO. Our affiliates, licensors and/or our suppliers in the UK, US and other countries are protected by UL and international trade mark laws. Except in connection with placing an order for merchandise or as required by applicable law you may not use, reproduce, duplicate, copy, sell, resell, access, modify or otherwise exploit our intellectual property or that of our affliates, licensors or suppliers without our, or their prior consent.
16.1. This website, any content contained herein and any contracts, sale and the supply of the goods, entered into as a result of usage of this website are governed by English law. The parties to any such contract agree to submit to the exclusive jurisdiction, in respect of any dispute arising from the contract, of the courts of England and Wales. All contracts are concluded in English.
16.2. O'FILIGO makes no representations or warranties in connection with this website, whether express or implied, including but not limited to warranties of satisfactory quality, non-infringement or fitness for a particular purpose, except to the extent such warranties are not legally excludable.
16.3. To the fullest extent permissible O'FILIGO will not be liable for interruption of business; loss or damages of any kind incurred as a result of dealings with or the presence of the website or off-website links; access delays or access interruptions to the website; computer viruses, system failure or any malfunction which may occur in connection with your use of our website; any inaccuracies or omissions or misleading, false or deceptive statements in the content; or, any events beyond O'FILIGO's reasonable control.
16.5. Furthermore, to the fullest extent permitted by law we will not be liable for any direct, indirect, special, incidental, consequential or other damages of any kind related to your use of the website and in no event shall our maximum aggregate liability exceed one hundred pounds sterling.
16.6. Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of O'FILIGO or any of its employees or agents or fraud.
16.7. These disclaimers and exclusions shall be governed by English law. If any provisions of these disclaimers and exclusions are deemed to be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
